Terms and sales conditions

  • PREAMBLE AND PURPOSE
    These conditions are agreed between Silampos 2, Praça Luís Ribeiro, 193, S. João da Madeira (Portugal), and anyone who wishes to make purchases through the website www.silampos2.pt, hereafter client.
    The computerized records, kept safely in the computer systems of Silampos 2 store will be considered as proof of communications, orders and payments made between the parties.

    Silampos is not liable for damage arising from interference, interruptions, computer viruses, breakdowns or other operating system abnormalities that might constrain or prevent access to our services.

    The shipment of orders will be made to the Portugal, Madeira and Azores islands and some foreign countries.

    These conditions refer only to singular persons not traders.

    The parties agree that their relations will be governed exclusively by the general conditions described herein.

    These conditions aim to define the selling arrangements between Silampos 2 and the client, ordering services or products, through the payment and delivery. These conditions regulate all steps necessary to accomplish the order and ensure the follow-up between the parties.

    Silampos Shop reserves the right to change the conditions of sale without prior notice.

  • PRODUCT
    The product images are illustrative only and may not correspond exactly to the actual product, but to the mentioned features. The availability of items is limited to existing stock. In the absence of product availability, Silampos 2 undertakes to inform the customer and refund him (if he has already made the payment) within 30 days from the order date.
  • ORDER
    The client must register on Silampos 2 website to be able to order from the online catalogue. On completion of the order presupposes the acceptance of prices and description of products available for sale, which are the only applications to the contract thus concluded.

    When placing your order, the user expresses its full and complete acceptance of the general conditions of sale, prices and description of the products included in this transaction. These general conditions of sale are the only applicable ones between the two parties.

    The customer will receive an email copy of the order. The order placed by the user is subject to confirmation by Silampos 2.
  • DELIVERY
    IMPORTANT NOTE: Orders paid from the 6th of August will be delivered from the 27th of August, 2019

    Silampos offers different delivery modes:

    - Delivery at Silampos 2 store (Portugal)
    The order can be raised in Silampos 2 store (Praça Luís Ribeiro, 193 - São João da Madeira - Portugal) by choice. Opening hours of the shop: Monday to Friday: 9:30am to 07:00pm. Saturday: 9:30am to 6:00pm.

    - In Pickup Points   
    Pickup network makes it more convenient and practical to send and collect orders, by offering convenience and easiness, 7 days a week, in the most practical time for you. There are more than 420 stores at your disposal, with many of them in shopping centers. It also has a great advantage, alerts via SMS, with information about the delivery of your order at the chosen store. Moreover, it is also of note that the Pickup points are the most economical solution.

    After choose this delivery option, you will receive a warning SMS or email to notify you that your order is now available in the Pickup Delivery Point, previously chosen by you. If you have not carried out the survey, on the eighth day you will receive a new SMS to inform that you still have 2 days to do so, therefore the maximum period of 10 days. Bring your Identity Card or Citizen Card.

    ATTENTION: For pickup deliveries, the customer must fill in the mobile phone number in the proper registration field, otherwise he could not be notified when an order is available at the pickup point. If the customer do not withdraw within 10 days of receiving the message, the order will only be reactivated after the customer made payment of the second delivery (see values ​​in the chapter "Shipping table").


    - Delivery at home - Portugal (mainland)  
    Products will be delivered by carrier maximum of 8 working days after payment receipt date, except in the following cases: stock rupture, absence of the recipient at the place of delivery or failure of the carrier. Note also that after confirmation of payment, an email will be sent to the client with the date of dispatch of your order. Deliveries will be made only on weekdays between 9:00am - 06:00pm. If you want to receive the order in another address or a specific day/time, this intention must be clearly written in the specified field.

    If you are not at the indicated address, your order will be forwarded to the nearest Pickup you. This allows you to pick up your order within a maximum of 10 days.

    - Delivery at home - Portugal (islands: Azores/Madeira)  
    Products will be delivered by carrier (sea) no more than 20 working days after receipt of payment, except in the following cases: stock rupture, the recipient's absence at the place of delivery or failure of the carrier. Deliveries will be made only on weekdays between 9:00am - 06:00pm. If you want to receive the order in another address or a specific day/time, this intention must be clearly written in the specified field.

    - International delivery   
    The order will be effected only after confirmation of shipment values, calculated according to weight, size and destination country. The customer will then receive an email with the amount to be paid. Note also that after confirmation of payment, an email will be sent to the client with the date of dispatch of your order. Products will be delivered by carrier at most 15 working days after receipt of payment, except in the following cases: stock rupture, absence of the recipient at the place of delivery or failure of the carrier. 


    • LOSS
    In case the order does not arrive within the time specified by the carrier entity, prompted the customer the necessary documentation in order to make a claim process. Silampos 2 is required to wait for completion of the transport company survey before making a referral or refund the purchase. This deadline is imposed by the carrier to which Silampos 2 is linked to. 

    • FREIGHT CHART
    The value of postage varies depending on the destination (Portugal, Islands or abroad) and the selected delivery mode (Domicile or Pickup Points).

  • PAYMENT
    Payment shall be made in advance, by ATM, credit card, paypal or bank transfer. All requested confidential data will be used to pay the order.
    Payment must be made within 10 days of the order shipment date.After this period, the order will be canceled.
    Thus, Silampos offers various modes of payment:

    - Credit card 

    In this way, place your order and choose the mode of payment credit card. You will be automatically redirected to the Redunicre payment page where you will have to fill in the requested data.


    - MBWay

    To make payments using MBWay, you must first install the mobile app. When ordering, select the MB WAY payment method. Then enter your mobile number and finally confirm notifications in the app.
    You must confirm your purchase within 15 minutes. After this timeout, the purchase order expires and you will need to repeat the purchase process to receive a new notification.


    - ATM  

    Another way to make your payment of your order is through the mode of payment by ATM.
    - Place your order and choose the ATM payment mode.
    - You will receive an email with the data for payment and the continuation of the order.
    - Make the payment using cash machine or home banking service. You just need to follow the following instructions:

    • In the case of carrying out a transfer through the ATM or through the home banking service:
    1.Select the menu: Payments and other services;
    2.Select the option: Service payments / purchases;
    3.Enter the data received: Entity, Reference and Value.
    4.Confirm the entered data; 
    5.Print the receipt of your payment and send a copy to the following email: suporte_portal@silampos.pt.


    - Paypal   

    In this way, place your order and choose Paypal payment mode. You will be automatically redirected to the Paypal payment page where you will have to fill in the requested data.


    - Bank transfer

    When placing your order you can select the bank transfer payment and follow the instructions as below:

    In the case of carrying out a transfer through the ATM:
    1.Choose the option: Transfer / Interbank transfers in euros;
    2.Enter the total amount of your order and the VAT number: 504535749 or IBAN: PT50000706230012793000872. Wait for the receipt as proof of transfer;
    3.Send a copy of proof to accelerate the process of confirmation of your order to the following email: suporte_portal@silampos.pt.

    In the case of carrying out a transfer through the home banking service:
    1.Go to the home banking service of your bank (you need to know the data access to your online bank account);
    2.Select the Transfer / Interbank Transfers option;
    3.Enter the total amount of your order and the VAT number: 504535749;
    4.Send a copy of the proof of transfer to the following email: suporte_portal@silampos.pt.


    For reimbursement situations:
    • Items not collected or returns - reimbursement will be made by bank transfer.
    • Sold out or canceled articles - reimbursement will be made by bank transfer.
    • Order canceled - reimbursement will be made by bank transfer.

    - Payshop

    When you choose to pay through Payshop, you automatically access a reference that you should write down or print.
    Go to the nearest Payshop agent and provide the payment reference. Deliver the amount indicated. Keep the receipt of payment.

  • RETURNS
    The customer can withdraw from the purchase within 15 days of the product delivery date, communicating its intention by e-mail: silampos2@silampos.pt . The article must be returned with the original invoice and packing, with all accessories, offers and in perfect condition. Silampos 2 is not responsible and reserves the right to reject potential returns when the goods are in poor condition, by misuse or transport damage. Transport costs arising from the return or exchange will be Silampos 2 responsibility in case the article does not respond to the request. Otherwise the above expenses will be the customer's responsibility. The exchange or refund will be denied when there is a breach of these parameters. In case of refund, Silampos 2 shall make the payment by check or bank transfer within 30 days.

    - Returns through Pickup points  
     
    To proceed with the return of your articles by pickup points, just follow these steps:

    1. First, contact the store by email, to inform what you want to return, the reason and the condition of the product;

    2. Pack the item, as well as all accessories and offers you wish to return in the original packaging together with the invoice;

    3. Tell the store in advance about the delivery date of the item to be returned at the pickup point. The store will send you by email the transport guide which should be printed and attached to the packaging delivered at the pickup point.

    Upon receipt of your package in our facilities, we will proceed with the bank transfer. Reimbursement will be made within a maximum period of 30 days.



    - Returns in store Silampos 2

    Another way to make the return of the items is through our store.

    To proceed with the return of the goods to Silampos 2 store (Luis Ribeiro Square, 193 - São João da Madeira). Opening hours of the shop: Monday to Friday: from 9:30 am to 19h; Saturday from 9:30 am to 18h just follow these steps:

    1. Pack the items, as well as all the accessories and offers you want to return in the original packaging, along with the invoice;
    2. Go to the store and delivered the packaging.

    Upon receipt of your package in our facilities, we will proceed with the bank transfer. Reimbursement will be made within a maximum period of 30 days.
  • PRICES
    Prices of the products should be considered in euros (€), with included fees and taxes, but do not include the delivery costs. The VAT is 23%. The prices may be modified in the website at any time without notice. In the treatment of your whole order and any error rates which could possibly be showing on the site due to technical anomalies will be detected. In this situation the customer is contacted. If the price of the product displayed on the site is actually lower, the difference is returned. If the price exceeds the customer will be contacted and may accept or cancel the order.

    All products presented are limited to existing stock.
  • WARRANTY
    The products of this site benefit from a general two-year warranty against manufacturing defects. The consumer shall inform Silampos 2 the possible lack of conformity within two months from the date on which has detected the prerogative without which does not operate the security interest. The warranty period is counted from the date of purchase of the product and does not cover components subject to periodic replacement (when this applies), or the damage caused by negligent use, misuse, accident or deterioration through use. The warranty will only be considered upon presentation of the relevant proof of purchase. In case of non-compliance of the product with the contract, the consumer is entitled to this to be replaced without charge. It expires when unauthorized entities have repaired, modified or replaced component of the article. The expression "free of charge", behind used, refers to the expenses necessary to restore the product to conformity with the contract, including in particular the transport costs, hand labor and material. These costs and risks related to the shipment of the product and its subsequent return to the customer, are only Silampos 2 responsibility during the duty warranty period. The costs of maintenance and repair of the product not resulting from the application of the warranty will be charged to the consumer. The warranty is free and came automatically from the purchase of the product. The rights and duties of both parties are regulated and detailed in Decree-Law No. 67/2003, as amended by Decree-Law No. 84/2008, to which reference is made.
  • PERSONAL DATA TREATMENT
    Registration and requests made on this website require the collection and processing of personal data necessary for the provision of services and / or supply of products. More details are mandatory provision and, in case of lack or insufficiency of such data, Silampos 2 may not offer the product or service concerned. Silampos 2 will inform the clients of the mandatory nature of the provision of the personal data concerned.
    The collected personal data are processed by computer and stored in a specific database. These data are for the provision of contracted services as well as marketing activities.

    The user or client may request the amendment or removal of your data at any time, and oppose the use of data provided for marketing purposes and sending informative communications.

  • APPLICABLE LAW AND JURISDICTION
    In case of consumer dispute online, the consumer may resort to a dispute settlement system responsible for resolving disputes relating to contractual obligations arising from online sales contracts or services.

Silampos provides all the information so you can exercise your right to complain to an official body, third and impartial to the process, which will help to resolve the dispute in question.
